By accessing and using The Doctor Hub platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
The Doctor Hub refers to our smart hospital management system, including all software, applications, websites, and related services.
Any individual or entity that creates an account and uses our Service, including hospitals, clinics, healthcare providers, staff members, and patients.
Any patient information, medical records, prescriptions, lab reports, and other health-related data processed through our platform.
You must be at least 18 years old and have the legal capacity to enter into binding contracts. Healthcare institutions must be properly licensed and authorized to operate in their jurisdiction.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access or security breach.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
The Doctor Hub provides a comprehensive hospital management system that includes but is not limited to:
You agree to use the Service only for lawful purposes and in accordance with applicable healthcare regulations, including HIPAA, GDPR, and local data protection laws.
You shall not: (a) violate any laws or regulations; (b) infringe upon intellectual property rights; (c) transmit malicious code or viruses; (d) attempt unauthorized access to our systems; (e) use the Service for fraudulent purposes; (f) interfere with other users' access to the Service.
Healthcare providers using our Service must maintain all necessary licenses, certifications, and comply with professional standards and medical ethics.
We collect and process data as described in our Privacy Policy. By using the Service, you consent to such collection and processing.
We implement industry-standard security measures to protect healthcare data. However, no system is completely secure, and we cannot guarantee absolute security.
You retain ownership of all data you input into the Service. We claim no ownership rights over your healthcare data.
While we perform regular backups, you are responsible for maintaining independent copies of critical data.
By using our Service, you consent to receive electronic communications from us, including emails, SMS, WhatsApp messages, and in-app notifications.
We may send you service-related announcements, updates, and administrative messages. You cannot opt-out of these communications.
We may send promotional materials with your consent. You may opt-out of marketing communications at any time.
Our Service enables healthcare providers to generate and send prescriptions via SMS, WhatsApp, and other digital channels. Healthcare providers are solely responsible for the accuracy and appropriateness of prescriptions.
The Doctor Hub acts only as a technology platform. We do not provide medical advice or verify prescription accuracy. All medical decisions remain the responsibility of licensed healthcare providers.
Healthcare providers must obtain appropriate patient consent before sending prescriptions through digital channels.
Access to the Service requires payment of subscription fees as outlined in your selected plan. Fees are subject to change with 30 days notice.
Payment is due in advance on a monthly or annual basis. Failure to pay may result in service suspension or termination.
Subscription fees are non-refundable except as required by law or as explicitly stated in your service agreement.
All fees are exclusive of applicable taxes, which you are responsible for paying.
The Service, including all software, designs, text, graphics, and other content, is owned by The Doctor Hub and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.
You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DOCTOR HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless The Doctor Hub, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.
You may terminate your account at any time by contacting us. Termination does not relieve you of payment obligations for services already rendered.
We may suspend or terminate your access immediately for violations of these Terms, non-payment, or illegal activity.
Upon termination, your right to use the Service ceases immediately. We will provide reasonable access to export your data within 30 days of termination.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such modifications constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of courts in India.
Parties agree to attempt resolution through mediation before pursuing litigation.
These Terms constitute the entire agreement between you and The Doctor Hub regarding the Service.
If any provision is found unenforceable, the remaining provisions shall continue in full force.
Failure to enforce any provision does not constitute a waiver of that provision.
You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.
